Audi Lemon Law Claims in California

Easily distinguishable by its four rings, having a brand new Audi is considered to some as the epitome of having it all. Representing not just German engineering excellence, Audi also promises a long duration of luxury, performance, and reliability. After all, you’ve invested significantly—both financially and emotionally—in your vehicle, expecting years of trouble-free driving pleasure.

But what happens when that excitement turns on its head? When your premium Audi begins experiencing mechanical issues that multiple repair attempts can’t resolve? The disappointment can be overwhelming, especially considering the premium price tag you paid for what should be superior quality.

If you’re facing ongoing problems with your newly purchased Audi, you should find some comfort in knowing that California’s lemon law provides powerful protections for consumers stuck with defective vehicles.

The American Lemon Law Group specializes in holding manufacturers accountable. Having successfully litigated on behalf of our clients, we recovered more than $50 million for them.

We make sure to never back down and to get what is right for our clients. If you think you have a lemon, it’s time to get the legal advice you need from the experienced lemon law attorneys in Los Angeles.

How Can Audi Lemon Law Help Me?

California’s Audi lemon law provides significant protections for consumers who’ve purchased or leased defective vehicles. Under this consumer-friendly legislation, you may be entitled to a complete buyback of your vehicle or a replacement if your Audi has substantial defects that impair its use, value, or safety despite reasonable repair attempts.

Formally known as the Song-Beverly Consumer Warranty Act, California’s lemon law applies to both new and certain used Audi vehicles, providing comprehensive coverage for consumers facing persistent issues with their vehicles. Recent legal developments have clarified that used vehicles with unexpired manufacturer warranties are eligible for lemon law remedies if they were sold as Certified Pre-Owned (CPO) vehicles with a new car warranty issued at the time of sale.

When successful with an Audi lemon law claim, you may receive:

  • A complete refund of your purchase price
  • Reimbursement for registration fees, financing charges, and other expenses
  • Alternatively, a replacement vehicle of equal value

Is Your Audi a Lemon Car?

To qualify under California’s lemon law, your Audi must have substantial defects that impair its use, value, or safety, and these issues must persist despite a reasonable number of repair attempts. While every case is unique, here are the general criteria that may qualify your Audi as a lemon:

  • Your Audi has been subject to at least 2 repair attempts for a serious safety defect
  • Your Audi has undergone at least 4 repair attempts for the same substantial defect
  • Your vehicle has been out of service for repairs for a cumulative total of 30 days or more
  • The problems occurred within the warranty period or within 18 months of delivery

It’s important to note that Assembly Bill 1755, signed into law by Governor Gavin Newsom, will introduce new procedural requirements beginning in 2025. These include a 30-day pre-suit notice requirement (effective April 1, 2025) and changes to the statute of limitations, giving plaintiffs one year after the final warranty expires to file suit or six years total after the delivery of a vehicle.

Common Audi Defects That May Qualify for Lemon Law Claims

Based on documented defect patterns and manufacturer recalls, certain issues appear frequently in Audi vehicles. These recurring problems may qualify affected vehicles for lemon law protection:

  • MMI Touchscreen Failures: 2020-2022 A4 and Q5 models have experienced widespread MMI touchscreen delamination defects requiring expensive display replacements, often costing around $4,200 post-warranty.
  • E-tron Battery Junction Fires: A 2024 recall (24V212) addressed e-tron GT vehicles for potential battery junction fires, highlighting serious safety concerns.
  • False Parking Sensor Alerts: Certain recent models have come under scrutiny for persistent false parking sensor alerts that disrupt normal vehicle operation.

Documentation is crucial for building a strong lemon law case. Keep detailed records of all repair visits, including dates, descriptions of the problems, and copies of work orders. This evidence will be essential in demonstrating that your vehicle meets the criteria for a lemon law claim.

How Does Audi Lemon Law Buyback Work?

The Audi lemon law buyback process typically follows these steps:

  1. Documentation: Collect all repair records, purchase documents, and warranty information for your Audi.
  2. Legal Consultation: Contact an experienced Audi lemon law attorney for a free case evaluation.
  3. Demand Letter: Your attorney will send a formal demand letter to Audi outlining your claim and requested remedy.
  4. Negotiation: Your lawyer will negotiate with Audi’s representatives to secure a fair settlement.
  5. Resolution: If successful, you’ll receive a buyback or replacement vehicle. If Audi refuses to comply, your attorney may file a lawsuit.

With the upcoming changes from Assembly Bill 1755, the process will include mandatory pre-suit notice requirements starting April 1, 2025. The law also introduces expedited procedures, including early discovery, expedited depositions, and mandatory mediation for manufacturers who opt-in to these provisions.

Understanding the Buyback Formula

When Audi repurchases your vehicle under the lemon law, the compensation typically includes:

  • The full purchase price of your vehicle
  • All registration fees
  • Finance charges paid to date
  • Transportation costs related to the defect
  • Minus a usage fee based on mileage before problems began

The usage fee is calculated using a formula prescribed by law and represents the value you received from the vehicle before problems developed. This deduction is typically small compared to the overall compensation.
