Lemon Law for Motorcycles

Motorcycles may be smaller than cars or trucks, but the law still protects riders from being stuck with a defective bike. If your motorcycle keeps breaking down or can’t be repaired after several attempts in California, state law may allow you to seek a refund, a replacement, or a cash settlement.

California’s Lemon Law (part of the Song-Beverly Consumer Warranty Act) covers motorcycles purchased or leased with a manufacturer’s warranty. If your motorcycle has been in the shop for the same issue more than once and it’s still not fixed, it might qualify as a lemon.

Contact American Lemon Law Group online or call (877) 311-1133 today for a free consultation to learn more about your legal rights. With our contingency fee payment structure, we only get paid if you do.

What Makes a Motorcycle a Lemon?

Just like other types of vehicles, motorcycles must be safe and reliable. You expect it to start when you need it and operate without major issues on the road, as you should. If your motorcycle has mechanical defects that can’t be fixed after a reasonable number of attempts, it may meet the legal definition of a lemon.

Some of the most common issues that can lead to a Lemon Law claim include:

  • Engine stalling or failure
  • Faulty electrical components
  • Problems with the clutch, transmission, or brakes
  • Fuel system defects
  • Steering instability

If the defect started while the motorcycle was still under warranty, you may have a valid claim even if the warranty has since expired. It’s also important that the issue hasn’t been caused by abuse, unauthorized repairs, or an accident.

Which Motorcycles Qualify Under the California Lemon Law?

Most motorcycles sold with a manufacturer’s warranty are covered by the California Lemon Law. That includes bikes from major brands like Honda, Yamaha, Harley-Davidson, Suzuki, Kawasaki, KTM, and BMW. The law doesn’t require that you use the motorcycle daily or put a certain number of miles on it. Rather, it only matters that the bike is still under warranty when the problem starts and that you give the manufacturer a fair chance to fix it.

Some certified used motorcycles may also qualify, as long as they were sold with a factory-backed warranty and the issues began during that period.
